Brazilian President Luiz Inácio Lula da Silva has signed Law No. 15,070, which regulates the production, commercialization, and all other aspects of biological inputs for agricultural, livestock, aquaculture, and forestry use.
The publication was made in the Official Federal Gazette (DOU) on December 23, 2024.
The provisions of Law No. 15,070 apply to all cultivation systems, including conventional, organic, and agroecological-based farming. The new regulation also includes all bioinputs used in agricultural activities.
The law covers various aspects related to bioinputs, such as production, import, export, registration, commercialization, use, inspection, supervision, research, experimentation, packaging, labeling, advertising, transportation, storage, fees, service provision, waste and packaging disposal, and production incentives.
The publication also states that control, registration, inspection, and supervision of products and establishments fall under the jurisdiction of federal, state, or district agencies responsible for agricultural defense. The law also regulates the registration of establishments and products, production for own use, commercial production, and the competencies of each.
The concepts of "biofactory, bioinput, livestock bioinput, aquaculture bioinput, organic agriculture approved bioinput, ingredient or active principle, bioinput inoculum, raw material, among others" are also defined.
The Agricultural Defense Establishment and Product Registration Fee (Trepda) was also instituted. This fee refers to the regular exercise of administrative police power and control of registration activities provided by the law. It will only be charged for evaluating and modifying registrations that require technical analysis of bioinputs produced or imported for commercial purposes and for establishments that produce or import for this purpose.
"Today, we experience another historic day for Brazilian agriculture. The responsibility for Brazil's sustainability is ours, and bioinputs will certainly be protagonists in our path to sustainable development," emphasized Agriculture and Livestock Minister Carlos Fávaro.
Agricultural Defense Secretary Carlos Goulart stated, "The publication of the new law is an important milestone for sustainable agriculture in Brazil, reinforcing our position of global leadership in the production and use of bioinputs. For almost 20 years, the country has stood out for innovation and registration of bio-based products, adopting environmentally sustainable, safe solutions that increase agricultural efficiency and productivity."
"With specific legislation for bioinputs, Brazil also becomes a global reference in regulatory matters, embracing all science and innovation applied to bio-based products, providing legal security to different bioinput use models, and maintaining rigor in product analysis without creating or increasing bureaucracy," Goulart emphasized.
Brazilian Secretary of Innovation, Sustainable Development, Irrigation, and Cooperativism, Pedro Neto, stated that "the publication of Law 15,070 demonstrates that Brazil is rapidly advancing in this agenda, presenting provisions that direct incentives for research and development, differentiated credit rates for producers, and training programs that facilitate the production and use of bioinputs."
"We are taking an important step with this new law, which will surely help position and reinforce Brazil as a country that practices agriculture rich in technology and based on biological and sustainable principles," Neto stressed.
Industry Celebrates
Brazilian biological input industries generally approved the new law. Marcelo Godoy, President of ABINBIO (Brazilian Association of Bioinput Industries), stated that the approval is "a major milestone for the bioinputs sector." The executive highlighted the demanding regulations established for producing on-farm inputs, which must comply with strict aspects of safety, quality, and inspection.
"Furthermore, the work carried out with legislative and executive bodies in the federal capital allowed for closer relations between the bioinput industry and rural producers, which undoubtedly strengthens agribusiness and Brazilian industry. As an association, we are fully aware that the segment needs regulation that guarantees security for both industry and producers. Without a doubt, we understand that the approval of Law 15,070 largely provides this security. Now, our mission is to continue working with the Brazilian government and Parliament, always raising the flags of agribusiness, industry, and our beloved homeland, as we are a reference in food production and microbiological technologies for the entire planet," Godoy said in conclusion.
