Back on May 31, 2018, the Chinese Ministry of Commerce issued its Announcement No. 42 of 2018, deciding to impose anti-dumping duties on the imported m-phenoxybenzaldehyde originating in India, to be implemented from June 8, 2018, with a duty rate of 36.4%-56.9% for a period of five years.
On March 7, 2023, the Chinese Ministry of Commerce received an application for expiry review on the anti-dumping measures, as submitted by Weifang Maoyuan Biotechnology Co., Ltd on behalf of Chinese m-phenoxybenzaldehyde industry. The applicant claims that if the anti-dumping measures were terminated, the dumping of imported m-phenoxybenzaldehyde originating in India to Chinese market would continue or recur, which may cause injury again to the Chinese industry. The applicant asks the Chinese Ministry of Commerce to conduct an expiry review on the imported m-phenoxybenzaldehyde originating in India, and to maintain the anti-dumping measures on the imported m-phenoxybenzaldehyde originating in India.
In accordance with the provisions of the Regulations of the PRC on Anti-dumping, the Chinese Ministry of Commerce examined the applicant’s corporate qualification, the product in question and the similar product situation in China, the status of import of the product in question during the implementation of the anti-dumping measures, the possibility of reoccurrence of dumping, the possibility of recurrence of injury as well as the relevant evidence at hand. The available evidence at hand indicates that the applicant and the applicant’s supporting enterprises comply with the provisions of Articles 11, 13 and 17 of the Regulations of the PRC on Anti-dumping concerning industry and industry representativeness, and are therefore eligible to submit the application on behalf of the Chinese m-phenoxybenzaldehyde industry. The investigatory authority believes that the applicant’s claim and the submitted prima facie evidence fall in line with the expiry review requirement.
Pursuant to Article 48 of the Regulations of the PRC on Anti-dumping, the Chinese Ministry of Commerce has decided to conduct an expiry review on the anti-dumping measures applicable to the imported m-phenoxybenzaldehyde originating in India, beginning from June 8, 2023.
