On April 6, 2011, EPA published a Federal Register notice proposing changes to labeling regulations for the export of unregistered pesticide products and devices. The proposed rule will help eliminate ambiguity, clarify the current regulations, and assist compliance.
EPA is also proposing to include label language to identify unregistered pesticide products and devices shipped between establishments operated by the same producer. Under the rule, labels of unregistered pesticide products and devices would clearly state "Not Registered for Use in the U.S." This label improvement is expected to protect public health and the environment by ensuring safe and appropriate handling and distribution.
Federal pesticide law allows pesticide manufacturers in the United States to produce pesticides for export markets even if the pesticide is not approved for use in this country. This rule, once final, is intended to prevent unregistered pesticide products and devices from inadvertently entering the U.S. market.
