Brazilian Justice orders reopening of Nortox factory

Debtor Judge José Zuquim Nogueira of the Justice Tribunal of Mato Grosso in Brazil has allowed the reopening of the Nortox factory in the municipality of Rondonópolis.

 

The decision followed an appeal filed by the company of agrochemicals and reformulated the previous decision of the Third Floor of that municipality, which is 250 kilometers from the capital of Mato Grosso, Cuiabá.

 

The magistrate revalidated the environmental licenses of the unity, which were suspended since last February. Nortox has been active in the states since 2012, with its headquarters located in the city of Apucarana, Paraná. According to the Judge, the decision sought to act “the closest possible to the principle of reasonability, not allowing that the passion overcomes the reason of the player, and not unbalance the juridical decision or affect the rights of the individuals with good faith in environmental issues.”

 

The dispatch referred to the first instance decision, in which the judge Milene Beltramini attended the request of the Public Ministry. The attorney requested the suspension of activities and environmental licenses until the realization of the Environmental Impact Study and the Report of Environmental Impact of the Nortox unit.

 

Judge Zuquim reminded that the installation of the company is, “in the terms of the law that determined the Participative Director Plan of Urban Development and Environmental of the municipality of Rondonópolis and the Use of the Law and Occupation of the Soil.”

 

It also pointed out that Nortox had obtained all the environmental licenses and all of these agencies enforced the business without “any type of illegality of irregularity in its concession, to justify the suspension.”
