Qiangr Biochemical wins patent suitqrcode

The Chinese agrochemical company, Qiangr Biochemical (Heilongjiang), has won a legal battle over violation of its pesticide patent rights against fellow subsidiary companies of the pharmaceutical and agrochemical company, Along Tibet (Chengdu). Qiangr Biochemical took legal action against Sichuan Jinzhu Ecology and Agriculture, Tibet Jinzhu and Jundong Seeds, which were accused of violating the patent rights of its antibiotic active ingredient, ningnanmycin. The case was brought to the Ha’erbin city court and the high court of Heilongjiang province.
The high court of Heilongjiang province ruled that: Tibet Jinzhu and Sichuan Jinzhu must immediately cease all violations of Qiangr Biochemical’s ningnanmycin patent; Sichuan Jinzhu is responsible for compensating Qiangr Biochemical’s economic losses to the “reasonable” amount of Yuan 3.5 million ($511,000); Sichuan Jinzhu must pay Yuan 150,000 ($21,915) in compensation to Qiangr Biochemical as a result of violating patent rights; and Jundong Seeds must immediately cease sale of ningnanmycin produced by Sichuan Jinzhu. Sichuan Jinzhu is also responsible for paying legal fees totalling Yuan 61,270 ($8,952).
