On June 27, 2024, the Ministry of Commerce (MOFCOM) issued the Announcement Ref 2024-25 on the launch of an Expiry Review of Anti-dumping for anti-dumping measures applicable to the imported toluidine originating in the European Union (EU).
The ministry decided that from June 28, 2024, it would conduct an Expiry Review of Anti-dumping for anti-dumping measures applicable to imported toluidine from the EU.
On June 27, 2013, the Ministry of Commerce issued the Announcement Ref 2013-44, to impose anti-dumping duties on imported toluidine originating in the EU, effective from June 28, 2013, at tax rate of 19.6%-36.9% for five years. On June 27, 2019, MOFCOM issued Announcement Ref 2019-28, deciding to continue to impose anti-dumping duties on imported toluidine originating in the EU for five years beginning from June 28, 2019.
According to the ministry’s announcement under ref 2021-3, at the end of the Brexit transition period on December 31, 2020, the trade remedy measures previously applied to the EU would continue to be applied to the EU and the UK, without change in the implementation period. After this date, the new trade remedy measures and review as applicable to the EU would no longer regard the UK as a member of the EU.
On April 22, 2024, the Ministry of Commerce received an application for an Expiry Review of Anti-dumping, as submitted by Jiangsu Huaihe Chemical Co., Ltd, Shandong Caike Dongao Chemical Co., Ltd and Hubei Kesai Chemical Co., Ltd on behalf of the Chinese domestic toluidine industry.
The applicants claim that if the anti-dumping measures are terminated, the dumping of imported toluidine originating in the EU to China might continue or recur, and the injury caused to the Chinese industry would continue or recur.
They requested the ministry to conduct an Expiry Review of Anti-dumping for the imported toluidine originating in the EU to maintain the anti-dumping measures imposed on the imported toluidine originating in the EU. The applicants did not file an application for an Expiry Review of Anti-dumping for the anti-dumping measures applicable to the imported toluidine originating in the UK.
Announcement on continued implementation of anti-dumping measures
According to the recommendation of the Ministry of Commerce, the Customs Tariff Commission of the State Council will continue to impose anti-dumping duties on imported toluidine originating in the EU by the scope and tax rates of the taxable products announced in Announcement Ref 2013-44 and the Announcement Ref 2019-28 of the Ministry of Commerce during the period of the Expiry Review of Anti-dumping. Beginning June 28, 2024, the anti-dumping measures applicable to the imported toluidine originating in the UK expire.
The rates of anti-dumping duties imposed on the EU companies as follows:
1.19.6% on LANXESS Deutschland GmbH 19.6%
2.36.9% on the rest of EU companies
Period of Expiry Review of Anti-dumping
The period of Expiry Review of Anti-dumping is from January 1, 2023 to December 31, 2023; the period of industrial injury investigation is from January 1, 2019 to December 31, 2023.
