DuPont has agreed not to pursue patent infringement litigation against the Chinese agrochemical company, Rotam (Hong Kong), over the monohydrate form of the sulfonylurea herbicide, nicosulfuron. The “patent non-assertion agreement” covers the manufacture, marketing and sale of the herbicide in the US. Rotam has agreed to pay an undisclosed fee to DuPont in return for the non-assertion deal.
The agreement allows Rotam to provide its US customers with “granular nicosulfuron manufactured by Rotam”, says its North America president Alvaro Canizares. The company received US approval for a 75% water-dispersible granule formulation of nicosulfuron, Primero, for use on maize earlier this year. DuPont sells a similar formulation as Accent.
DuPont says that the Rotam deal allows it to “obtain fair value for its intellectual property rights”, according to John Chrosniak, DuPont’s regional director for North America. The agreement does not affect any other issues that exist or may arise between the parties over nicosulfuron, the companies point out.
