Metamifop - Joint Anti-Counterfeit Announcement

To all manufacturing enterprises, formulation sales companies, foreign trade corporations, distributors, and farmer friends,

As manufacturers (Ningxia Lamtin Agricultural Development Co., Ltd., and Jiangsu Fuding Chemical Co., Ltd.,) of Metamifop technicals with three certificates authorized by official departments in China (pesticides business license, pesticides registration certificate and pesticides production license).

We have been worked on producing products that have high content, are highly effective and are of high quality. Currently, there were still some underground factories that produce and sell illegally in our domestic market, which not only infringe our lawful rights and interests but also bring safety hazard and compliant risks to the production of Metamifop TC and formulation in the domestic factory. We received some of negative feedback from those who purchased or used these illegal products with doubtful active contents and specifications.

We hereby announce to you that the following actions are all suspected of constituting illegal activities：

1. Producing Metamifop technical products without obtaining a pesticide production license and ICAMA.

2. Producing Metamifop technical products without ICAMA despite obtaining a pesticide production license.

3. Producing Metamifop technical products without a pesticide production license despite obtaining ICAMA.

According to item 3 in Article 44 of the ″Regulations on Pesticides Administration″ (hereinafter referred to as the Regulations), pesticides produced without obtaining a pesticide registration certificate according to law shall be treated as fake pesticides. 

Article 52 of the Regulations stipulates that those who produce pesticides with commodity value are more than 10,000 yuan without obtaining a pesticide production license shall be fined more than 10 times and less than 20 times its value, and those who committed a crime according to its legal terms shall be investigated for criminal responsibility.

Article 20 and Article 53 of the Regulations stipulate that enterprises that produce pesticide formulations, such as purchased and used raw materials that have not legally obtained relevant qualifications, are also regarded as illegal actions. Meanwhile, the original name, Metamifop, was found in invoices issued in the current market, but they were produced by an underground factory. Please be advised that all manufacturers should have registration certificates for Metamifop technical, and if illegal actions that allow small factories to offer these invoices are known, please report them. As the responsible agrochemical enterprises in China, we have the obligation and responsibility to safeguard the legal business activities of domestic manufacturers of technicals and formulations, to ensure national food security and protect the legitimate rights and interests of all farmers.

We and Jiangsu Fuding Chemical Co., Ltd., will report the illegal actions that provide these mentioned invoices to underground factories and any involved legal enterprises to the relevant administration department, to safeguard the interests of all legitimate technical and formulation enterprises.

To cooperate with law enforcement administration in effectively cracking down on the above-mentioned illegal actions, we will rewards those who provide evidence. We will collect clues from all parties and remind those concerned of the following:

1. Remind "Metamifop" formulation manufacturers to cooperate with legal enterprises, to avoid the long-term legal compliance risks caused by illegally activities.

2. Remind the distributors of Metamifop formulation products to obtain a supplier’s invoice with the original name to protect their rights and interests.

3. Remind some domestic and export traders about legal and compliant trading that can be tracked from the terminal market in the domestic one, as well as obtain customs data from foreign customs. 

4. Remind domestic legal enterprises without an actual production license and that provide invoices for underground factories that their actions are illegal.

The evidence provided by the personnel of companies will remain confidential and will never be leaked.

The reward process is as follows: For the same illegal production enterprise, in terms of providing valuable evidence, such as enterprise name, address, raw material procurement, sales objects, sales channels and other information, the first informant will be rewarded with cash worth 200,000 Yuan, the second informant will be rewarded with cash worth 100,000 Yuan, and the third informant can be rewarded with cash worth fifty 50,000 Yuan. The order of informants will be sorted according to the authenticity, completeness, detail, and validity of their evidence. If the informant provides complete a transaction contract and transaction record information, they will be rewarded with 1 million Yuan in cash.

Reports from the community are also accepted. We work together to maintain the social environment of notarization and rule of law.
