Public Notice on Chlorantraniliprole by DuPont

Chlorantraniliprole is a new insecticide developed by DuPont. Approved by the Chinese regulatory agencies, Chlorantraniliprole has been launched in the Chinese market. The pesticide registration no.s include PD 20101971, PD20100676, PD20100677, etc.

DuPont owns a series of patents in many countries in the world including China covering the active ingredient Chlorantraniliprole, its manufacture, its use and compositions containing Chlorantraniliprole. According to the Chinese Patent Law, no one, without consent by the patentee, is allowed to manufacture, use, offer for sale, or sell any product containing Chlorantraniliprole for commercial purpose before the expiration of the patent.

In addition, according to Regulations on Control of Pesticides, three approval certificates are necessary for manufacture of pesticides, namely manufacture approval, pesticide registration and manufacture quality standard; anyone who does not obtain the pesticide registration certificate but manufactures or operates pesticides without authorization, shall be ordered to cease the manufacture or operation, have the illegal gains confiscated, and be imposed a fine; if serious, criminal liability shall also be investigated. The Regulations also provides that any pesticide shall be prohibited from being purchased or sold without the pesticide registration certificate, the license for pesticide manufacture, the product quality standard, the certification of fitness, or not passing the inspection.

Based on the above facts and regulations, DuPont herein announces publicly that:

● Any insecticide product comprising Chlorantraniliprole composition without the above three approval certificates is illegal.
● If any illegal Chlorantraniliprole insecticide is found by DuPont, we will cooperate with the competent government agencies to punish the violators by either administrative liability and / or criminal liability.
● DuPont reserves the right to initiate civil litigations before the People’s Court against all patent infringers;
● If anyone has any information relating to illegal activity with this active ingredient, please report to DuPont through the following law office:
