A panel of judges on the Ninth Circuit court has denied the motion by BASF to stay and recall the June 3rd mandate vacating BASF’s Engenia herbicide and two other dicamba registrations, Bayer’s XtendiMax and Corteva’s FeXapan.
In a statement to Brownfield, BASF says they disagree with the Court’s decision and will continue to pursue all legal remedies available. It says farmers must have access to the safe and effective crop protection solutions they’ve come to rely on. BASF says it will continue to pursue EPA re-registration of Engenia for the upcoming seasons.
Farmers and commercial operations can continue to apply any existing stocks of the herbicides as of June 3rd, for now, under the EPA’s cancellation order.
