It is reported that the subsequent appeal by Zhengjiang Jinfanda against
Wynca was dismissed by the Zhejiang Superior Court and uphold the original verdict. The tough 33months’ patent right lawsuit was finally culminated in favor of
Wynca.
The hydrolysis auxiliary process of
glyphosate was developed by
Wynca, is a cost-reducing technology and a radical solution for environmental impact during
glyphosate manufacturing process. It has patented in China and become a core patented technology of
Wynca. Jinfanda, a local pesticide producer in Zhejiang, was found illegally employed this technology without any authorization from
Wynca.
Wynca deemed it is an infringement of their legitimate rights and interests, thus they filed a lawsuit to the Hangzhou intermediate court in early 2008. After 20 months’ investigation and hearing, the court ruled Jinfanda a 20 million Yuan compensation to
Wynca for infringement. Jinfanda appealed to the high court against the verdict and challenged the validity of the patent to the SIPO (State Intellectual Property Office). The SIPO determined the patent validity of
Wynca and the high court uphold the original verdict.
Wynca welcomed the final judgment and said that this successful defending rights and interests by legal measures will heighten the awareness of the general public about IPR.
