The US and Canadian competition authorities have released statements confirming a final agreement with Nufarm on measures taken to ensure appropriate levels of competition following Nufarms acquisition (in March 2008) of AH Marks Holdings Limited.
AH Marks was a phenoxy herbicides manufacturing and supply business based in the UK.
The measures referred to involved the sale and/or transfer of some product registrations and regulatory task force seats by Nufarm to other companies and the restructuring of some supply agreements.
These measures were the subject of negotiations with the regulatory authorities over the past 18 months and all measures have already been put in place.
Nufarm confirmed that the agreements in question do not have a material impact on the anticipated value that Nufarm expects to secure from its acquisition of AH Marks.
