By Think Real - Reports from the AgriGoods Herald said that the People's Court of Xiangyin County, Hunan Province had recently reached a verdict that Hunan Dafang Agrochemical Co., Ltd. (Hunan Dafang) and the company’s general manager as well as legal representative named Liu Song committed the crime of counterfeiting registered trademark Fencer® and its figurative mark owned by the US-based Dow AgroSciences LLC by producing and selling penoxsulam-based herbicides. Xiangyin Plant Protection Co., Ltd. (Xiangyin Plant Protection) and its general manager as well as legal representative Liu Pengyu were also convicted of selling commodities under counterfeiting registered trademark because the company had been selling fake penoxsulam-based herbicides under Fencer® made by Hunan Dafang.
In March 2013, Hunan Dafang purchased 80 kg of penoxsulam technical through illegal channel and formulating it into herbicides under trademark Fencer®which is owned by Dow AgroSciences LLC and subject to patent protection without the permission of the latter. Hunan Dafang even sold the products valued at more than USD63,919 to Xiangyin Plant Protection for illegal sales.
Both companies and their legal representatives, sued by the People's Procuratorate of Xiangyin County, were respectively sentenced to a fine (exact amount unknown) and confiscation of illegal earnings.
