India: Gujarat High Court gave orders on Pesticides Registration Guidelines

IndiaThe Gujarat High Court pronounced order dated 6th May 2016 in favor of the Pesticides Manufactures and Formulators Association of India (PMFAI) with reference to New Guidelines established for TIM (Technical indigenous manufacture) v/s FI (Formulation Import) without registering Technical Grade Pesticides, which was followed by Registration Committee ( in compliance with interim orders of the Hon'ble High Court of Gujarat, dated, 05.09.2013 in WP No.2530 of 2011 & others), the same was challenged by Crop Life India (Assn of MNC) & PI Industries Ltd, Delhi to stop the registration of indigenous manufacturers approved in 365th Registration Committee meeting held on 22nd April 2016.
PMFAI appealed against the single judge order of 26th April, 2016 in SCA No.6462 of 2016. After hearing both the sides, Honourable Chief Justice Mr. R. Subhash Reddy and Honourable Mr. Justice Vipul M. Pancholi, approved the action of Registration Committee & New guideline (TIM v/s FI) and stayed the order passed on 26th April 2016 by Single Judge Honourable Mr. Justice N.V.Anjaria. Central Insecticide Board and Registration Committee can now issue the Registration Certificates under new guidelines (TIM v/s FI). This will support “Make in India”, “Made in India“ and will open a flood gate of pesticides formulations for the farmers at reasonable, affordable price and many more formulations will be available.
