BASF SE recently announced a patent statement for its pyraclostrobin patent in China so as to protect the patent right of the product.
Pyraclostrobin is a fungicide developed by BASF. BASF possesses a patent for active ingredient, synthetic method and the use of pyraclostrobin under Patent Ref ZL95194436.3, which will expire in June 2015. Additionally BASF is in possession of patents for pesticide formulations containing pyraclostrobin under Patent Ref ZL97194054, ZL97197536.1, ZL98805666.6 and ZL98806337.9.
According to the provisions of the Patent Law of PR China, no companies or individuals shall, without the permit of patent holdersproduce, use, sell, offer to sell and import any products containing pyraclostrobin ingredients for any commercial purposes.
BASF is the only company that has obtained pyraclostrobin fungicide and mixed pesticide registrations in China, being also entitled to importation, authorized capsulation and distribution of pyraclostrobin technical and formulation products. According to China’s Regulations on the Control of Agricultural Chemicals, pesticide which contains or is alleged to contain pyraclostrobin ingredients without legally obtained registration certificate is regarded as illegal products; for such act responsible authorities shall impose an administrative punishment or criminal responsibility whereas the case constitutes a crime.
