A parliamentary group of Rio Grande do Sul, including president of the State Foundation of  Natural Environment Protection (Fepam), are articulating for the prohibition of paraquat sales in that jurisdiction. They will deliver this week a "motion of unconformity" against the decision of the state's Court of Justice that released the sales of paraquat manufactured by Helm and Syngenta.

The court considered this initiative is illegal. According to the court, the agency Fepam does not have legal competency to impede the commercial use of products released by the National Agency of Health Surveillance(ANVISA).

The politicians invoked the law 7.747/82, which says that imported products can only be allowed in Rio Grande do Sul if authorized in the country of origin. They allege that this is the case of Paraquat, which is banned in the European community for over five years.

The state appealed against the decision of the court and requesting that the issue should be assessed by the Supreme Court. The president of the Court of Justice submitted the agenda to the Supreme Court, but it first granted a provisional release for paraquat sale in Rio Grande do Sul.
