Brazilian state agency appeals on sales of paraquat-based productsqrcode

The State Foundation of Natural Environment Protection (Fepam) from the Brazilian state of Rio Grande do Sul will appeal to Federal Supreme Court to reestablish the prohibition of the sales of aghems that have paraquat as active ingredient. According to Fepam, the release allowed by the Civil Chamber of the Court of Justice in June is contrary to state law number 7747/82 - which determines that agchems cannot be used if not released in the states.
 
To release the use of paraquat, the Court of Justice of Rio Grande do Sul has argued that the products manufactured by Helm do Brasil, Syngenta and Simon are registered on federal level by the National Agency of Sanitary Surveillance (Anvisa). Therefore, Fepam would not have the authority to impede the sales.
 
According to the coordinator of legal advisory to Fepam, Cristiane da Silva, abundant technical documentation related to the restriction of these products exists, and there are studies related to the toxicity of Paraquat. Cristiane explains that Fepam appealed on the decision because of the dangers, and she highlighted that the state can have more restrictive laws than the federal on the attributions of protecting the population health and the environment.
